AN ACT to amend the social services law, in relation to establishing the
  post-adoption support services pilot program

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Article 6 of the social services law is amended by adding a
new title 12 to read as follows:
                                TITLE 12
              POST-ADOPTION SUPPORT SERVICES PILOT PROGRAM
SECTION 458-N. POST-ADOPTION SUPPORT SERVICES PILOT PROGRAM.
  S  458-N.  POST-ADOPTION SUPPORT SERVICES PILOT PROGRAM. 1. AS USED IN
THIS SECTION:
  (A) "POST-ADOPTION SUPPORT SERVICES" MEANS MEDICAL  TREATMENT,  MENTAL
HEALTH  SERVICES,  PARENTING  CLASSES,  OR  ANY  OTHER  DIRECT  SERVICES
PROVIDED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES AFTER A CHILD  IS
ADOPTED THAT:
  (I)  AID AN ADOPTED CHILD OR ADOPTIVE FAMILY IN WHICH AN ADOPTED CHILD
IS IN CRISIS; AND
  (II) ASSIST IN PREVENTING THE CHILD FROM BEING RETURNED  TO  THE  CARE
AND SUPERVISION OF THE OFFICE OF CHILDREN AND FAMILY SERVICES.
  (B) "PROGRAM" MEANS THE POST-ADOPTION SUPPORT SERVICES PILOT PROGRAM.
  2. THE PURPOSE OF THE PROGRAM IS TO:
  (A)  PROVIDE  POST-ADOPTION  SUPPORT  SERVICES TO ADOPTED CHILDREN AND
THEIR ADOPTIVE FAMILIES; AND
  (B) PROVIDE ADDITIONAL STATE FUNDS FOR ADOPTED CHILDREN.
  3. AT THE REQUEST OF AN  ADOPTIVE  PARENT  FOR  POST-ADOPTION  SUPPORT
SERVICES  FROM  THE  LOCAL  SOCIAL  SERVICES  DISTRICT, THE LOCAL SOCIAL
SERVICES DISTRICT SHALL CONTINUE A CLINICAL ASSESSMENT OF THE  NEEDS  OF
THE ADOPTED CHILD AND ADOPTIVE FAMILY.
  4.  AFTER  A  DETERMINATION BY THE LOCAL SOCIAL SERVICES DISTRICT THAT
THE ADOPTED CHILD OR ADOPTIVE FAMILY IS IN NEED OF POST-ADOPTION SUPPORT
SERVICES, THE LOCAL SOCIAL SERVICES DISTRICT  SHALL  SUBMIT  A  PROPOSED
