BILL NUMBER:S2426 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to foot pegs for motorcycle passengers PURPOSE: To reduce the risk of injury to motorcycle passengers by requiring that any passenger must be able to plant both feet on the motorcycle foot pegs easily and readily for him to be able to ride on the back of a motorcycle in the State of New York. SUMMARY OF PROVISIONS: Section 1 - Subdivision 13 of section 381 of the vehicle and traffic law is renumbered subdivision 14 and a new subdivision 13 is added. Section 2 - Establishes the effective date. JUSTIFICATION: Children currently are permitted to ride as passengers on motorcycles regardless of their age or height. These individuals would be required to be able to reach and plant both feet on the pegs affixed to the motorcycle. This requirement would reduce the risk of being thrown from the motorcycle should the operator stop too quickly or

DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to foot pegs for motorcycle passengers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 13 of section 381 of the vehicle and traffic law is renumbered subdivision 14 and a new subdivision 13 is added to read as follows: 13. NO PERSON SHALL OPERATE A MOTORCYCLE ON ANY HIGHWAY WITH A PASSEN- GER UNLESS SUCH MOTORCYCLE IS EQUIPPED WITH FOOT PEGS FOR SUCH PASSENGER AND SUCH FOOT PEGS ARE LOCATED ON SUCH MOTORCYCLE AT A PLACE WHERE SUCH PASSENGER CAN EASILY AND READILY PLANT BOTH OF HIS OR HER FEET ON SUCH FOOT PEGS. S 2. This act shall take effect on the sixtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
