BILL NUMBER:S2681 TITLE OF BILL: An act to amend the parks, recreation and historic pres- ervation law and the state finance law, in relation to establishing a historic preservation revolving loan program PURPOSE: To establish a revolving loan fund for the purposes of histor- ic preservation. SUMMARY OF PROVISIONS: This bill amends the Parks, Recreation and Historic Preservation Law by adding a new section 14.11, which directs the Commissioner of the Office of Parks, Recreation and Historic Preser- vation to establish a historic preservation revolving loan fund. Section 2 amends the State Finance Law by adding a new section 91-e, placing jurisdiction of this fund under the State Comptroller and the Commis- sioner of Taxation and Finance. JUSTIFICATION: Many communities do not have the resources available to engage in the preservation of local historic sites. These sites, which could improve the culture, economic, and historic value of a region, are often neglected. YOUNG, LITTLE, MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law and the state finance law, in relation to establishing a historic preser- vation revolving loan program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The parks, recreation and historic preservation law is amended by adding a new section 14.11 to read as follows: S 14.11 HISTORIC PRESERVATION REVOLVING LOAN PROGRAM. 1. THE COMMIS- SIONER SHALL ESTABLISH AND MAINTAIN A HISTORIC PRESERVATION REVOLVING LOAN PROGRAM TO PROVIDE LOANS TO MUNICIPALITIES FOR ANY PURPOSE DESIG- NATED IN THIS ARTICLE. SUCH PROGRAM SHALL PROVIDE INTEREST FREE LOANS TO MUNICIPALITIES FOR SUCH LOCAL HISTORIC PRESERVATION PROJECTS AS THE COMMISSIONER SHALL DEEM TO BE ELIGIBLE PURSUANT TO RULE OR REGULATION. 2. THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS FOR THE PURPOSE OF CARRYING OUT THE PROVISIONS OF THIS SECTION, INCLUDING ESTAB- LISHING: (A) AN APPLICATION PROCESS WHEREBY MUNICIPALITIES MAY APPLY FOR LOANS; (B) CRITERIA AND STANDARDS FOR DETERMINING A LOCAL HISTORIC PRESERVA- TION PROJECT'S ELIGIBILITY FOR A LOAN; (C) CRITERIA AND STANDARDS FOR DETERMINING THE PRIORITY TO BE GRANTED AMONG LOCAL HISTORIC PRESERVATION PROJECTS; (D) CRITERIA AND STANDARDS FOR DETERMINING THE AMOUNT OF FINANCIAL ASSISTANCE TO BE PROVIDED TO A MUNICIPALITY FOR A LOCAL HISTORIC PRESER- VATION PROJECT; AND (E) CRITERIA AND STANDARDS TO BE USED IN DETERMINING THE LOAN REPAY- MENT PERIODS AND THE TERMS OF ANY REPAYMENT AGREEMENTS. 3. THE OFFICE MAY PROVIDE FINANCIAL ASSISTANCE TO MUNICIPALITIES WITH- IN THE AMOUNTS AVAILABLE IN THE HISTORIC PRESERVATION REVOLVING LOAN EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
