BILL NUMBER:S4226 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the registration of vintage snowmobiles; and to amend the parks, recreation and historic preservation law, in relation to a fee for snowmobile trail development and maintenance PURPOSE: To establish a reduced registration fee ($25 total) for snowmobiles that are 25 years or older. SUMMARY OF PROVISIONS: Amends subdivision 4-a of section 2222 of the vehicle and traffic law in relation to establishing a vintage sled fee which supports trail maintenance and development; creates a new subdivision 4b of section 2222 of the vehicle and traffic law providing for a definition of a vintage snowmobile and establishing a registration fee payable to the general fund and amends section 21.07 of the parks, recreation and historic preservation law by adding a new subdivision 3 establishing a fee to be paid to the trail development and maintenance fund from the registration of a vintage snowmobile. JUSTIFICATION: The collecting and restoration of vintage sleds (those which are 25 years old or older), has become a popular pastime in the snowmobile community. Many of these collectors would like to register and ride their restored sleds but find the cost of registration disproportionately high when compared to the ability of these sleds to be ridden for any distance. SEWARD, FARLEY, LARKIN, LITTLE, MARCHIONE, RANZEN- HOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the regis- tration of vintage snowmobiles; and to amend the parks, recreation and historic preservation law, in relation to a fee for snowmobile trail development and maintenance THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4-a of section 2222 of the vehicle and traffic law, as amended by chapter 609 of the laws of 2005, is amended to read as follows: 4-a. Additional fee. In addition to the other fees provided for in paragraphs (a), (b) and (c) of subdivision four of this section the commissioner shall, upon application in such cases for the registration of a snowmobile or the renewal thereof, collect the annual ninety dollar fee for residents and ninety dollar fee for nonresidents and a thirty- five dollar fee for residents and thirty-five dollar fee for nonresi- dents who provide proof, at the time of registration, that such individ- ual is a member of an organized New York state snowmobile club that is a member of the New York state snowmobile association or is a member of an organized New York state snowmobile club that is a trail maintenance entity and a member of the New York state snowmobile association AND THE COMMISSIONER SHALL, UPON APPLICATION IN SUCH CASES FOR THE REGISTRATION OF A VINTAGE SNOWMOBILE COLLECT A FIFTEEN DOLLAR FEE FOR ANY RESIDENTS OR NONRESIDENTS WHO PROVIDE PROOF, AT THE TIME OF REGISTRATION, THAT SUCH INDIVIDUAL IS A MEMBER OF AN ORGANIZED NEW YORK STATE SNOWMOBILE CLUB THAT IS A MEMBER OF THE NEW YORK STATE SNOWMOBILE ASSOCIATION OR IS A MEMBER OF AN ORGANIZED NEW YORK STATE SNOWMOBILE CLUB THAT IS A TRAIL MAINTENANCE ENTITY AND A MEMBER OF THE NEW YORK STATE SNOWMOBILE ASSOCI- ATION which are imposed by section 21.07 of the parks, recreation and EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
