BILL NUMBER:S4241 REVISED 04/03/13 TITLE OF BILL: An act to amend chapter 118 of the laws of 1969, relating to a separate union free school district in the town of Greenburgh, in the county of Westchester, in relation to clarifying the authority of the Greenburgh North Castle Union Free School District to lease certain properties and to expand its boundaries PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to authorize the Greenburgh North Castle union free school district to lease properties for the purpose of providing instruction to students in the Greenburgh North Castle union free school district. SUMMARY OF SPECIFIC PROVISIONS: Section 2-c is added to chapter 118 of the laws of 1969 which clarifies the authority of the Greenburgh North Castle Union Free School District to lease properties and to expand its boundaries. Section 2-c of the bill authorizes the Greenburgh North Castle union free school district, subject to approval of the New York State education department, to lease properties located at 45 East Gainsborg Avenue in the village of West Harrison, county of Westchester and 100 North Broadway in the village of Irvington, Westchester County and to enter into any agreements necessary to lease the properties for the

STEWART-COUSINS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend chapter 118 of the laws of 1969, relating to a separate union free school district in the town of Greenburgh, in the county of Westchester, in relation to clarifying the authority of the Greenburgh North Castle Union Free School District to lease certain properties and to expand its boundaries THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2-a of Chapter 118 of the laws of 1969, relating to a separate union free school district in the town of Greenburgh, in the county of Westchester, as amended by chapter 226 of the laws of 2010, is amended to read as follows: S [2-a] 2-B. Notwithstanding any other law, rule, or regulation to the contrary, in addition to the powers granted by section two of this act, subject to the approval of the New York state education department, the board of education shall be authorized to lease properties located at 623 Blooming Grove Turnpike, in the town of New Windsor, county of Orange for the purpose of providing instruction to students enrolled in the school district. S 2. Chapter 118 of the laws of 1969, relating to a separate union free school district in the town of Greenburgh, in the county of West- chester, is amended by adding a new section 2-c to read as follows: S 2-C. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION TO THE CONTRARY, SUBJECT TO THE APPROVAL OF THE NEW YORK STATE EDUCATION DEPARTMENT, THE BOARD OF EDUCATION SHALL BE AUTHORIZED TO LEASE PROPER- TIES LOCATED AT 45 EAST GAINSBORG AVENUE IN THE VILLAGE OF WEST HARRI- SON, COUNTY OF WESTCHESTER AND 100 NORTH BROADWAY IN THE VILLAGE OF IRVINGTON, WESTCHESTER COUNTY AND TO ENTER INTO ANY AGREEMENTS NECESSARY TO CARRY OUT SUCH AUTHORITY, FOR THE PURPOSE OF PROVIDING INSTRUCTION TO EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
