BILL NUMBER:S4764 TITLE OF BILL: An act to amend the education law, in relation to standardized testing for kindergarten, grade one or grade two PURPOSE: This bill prohibits school districts from using state developed or comparable assessments for any purpose other than diagnosis. SUMMARY OF PROVISIONS: Section 1 amends section 305 of the education law to require the commissioner to prohibit the administration of state developed or other assessments to students in kindergarten, grade one or made two for any purpose other than diagnosis. Section 2 makes this act effective on July 1, 2013. JUSTIFICATION: Although the State does not require it, many school districts are beginning to administer commercially developed standardized tests to students in the early grades. These tests are not being used for diagnostic purposes or to identify academic needs. Assessing students in the early years should be used to help students develop the skills they will need in the future. These high stakes tests do not meet this objective.

NOTWITHSTANDING ANY OTHER PROVISION OF LAW OR REGULATION TO THE CONTRARY, THE COMMISSIONER SHALL PROHIBIT THE ADMINISTRATION OF STATE DEVELOPED ASSESSMENT OR OTHER COMPARABLE ASSESSMENTS TO STUDENTS ENROLLED IN KINDERGARTEN, GRADE ONE OR GRADE TWO THAT ARE BEING USED FOR ANYTHING OTHER THAN DIAGNOSTIC PURPOSES. PROVIDED FURTHER, SCHOOL DISTRICTS SHALL USE DISTRICT, REGIONAL, OR BOCES DEVELOPED ASSESSMENTS TO COMPLY WITH PARAGRAPH F OF SUBDIVISION TWO OF SECTION THREE THOUSAND TWELVE-C OF THIS CHAPTER FOR STUDENTS ENROLLED IN KINDERGARTEN, GRADE ONE OR GRADE TWO.
