BILL NUMBER:S5279 TITLE OF BILL: An act to amend the real property tax law, in relation to granting municipalities the authority to provide real property tax exemptions for certain cold war veterans PURPOSE: To allow municipalities to include military members who served under the Federal Reserve Forces Act of 1955 in the definition of "Cold War Veteran" for the purposes of real property tax exemptions. SUMMARY OF PROVISIONS: This bill would add a new subdivision to section 458-b of the real property tax law to give counties, cities, towns and villages the authority to adopt a local law granting those former military members that served under the Federal Reserve Forces Act of 1955 access to real property tax exemptions that the locality has in place for veterans. JUSTIFICATION: As it stands now, the brave men and women who answered the call to serve their country as reservists under the Federal Reserve Forces Act of 1955 do not fall under the definition of Cold War Veteran, and are

Section 458-b of the real property tax law is amended by adding a new subdivision 8 to read as follows: 8. A COUNTY, CITY, TOWN, OR VILLAGE MAY ADOPT A LOCAL LAW TO INCLUDE A MALE OR FEMALE VETERAN WHO SERVED UNDER THE FEDERAL RESERVE FORCES ACT OF 1955, PUBLIC LAW 305, 84TH CONGRESS (69 STAT. 598) DURING THE COLD WAR PERIOD WITHIN THE DEFINITION OF "COLD WAR VETERAN" AS PROVIDED IN PARAGRAPH (A) OF SUBDIVISION ONE OF THIS SECTION PROVIDED THAT SUCH VETERANS MEET ALL OTHER QUALIFICATIONS UNDER THE PROVISIONS OF THIS SECTION. S 2. This act shall take effect immediately and shall apply to assess- ment rolls on the basis of taxable status dates occurring on or after the second day of January next succeeding the date on which this act shall have become a law.
