BILL NUMBER:S5953 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to eliminating the photo image fee for veterans who have their license amended with a veteran notation PURPOSE: To remove the fee being charged to veterans who order a replacement identification card with the veteran designation. SUMMARY: Section 491 of the Vehicle and Traffic Law is amended to eliminate the renewal fee for veterans JUSTIFICATION: Under a newly enacted Chapter 487 of 2012, men and women who have served in the armed forces are eligible for a special drivers license that indicates their veteran status. There is no additional fee for those who want to receive the special designation when their license is up for its usual renewal. However, for those who want to obtain the new special license before their old license expires, DMV has announced it will charge the individual $12.50.

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the vehicle and traffic law, in relation to eliminating the photo image fee for veterans who have their license amended with a veteran notation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (d) of subdivision 2 of section 491 of the vehi- cle and traffic law, as added by chapter 295 of the laws of 1983, is amended to read as follows: (d) There shall be no fee other than a fee prescribed in paragraph (c) of this subdivision for an amended identification card. THERE SHALL BE NO FEE, INCLUDING THE FEE PRESCRIBED IN PARAGRAPH (C) OF THIS SUBDIVI- SION, FOR AN AMENDED IDENTIFICATION CARD FOR AN AMENDMENT THAT SOLELY ADDS A VETERAN NOTATION UPON SUCH IDENTIFICATION CARD THAT THE CARD HOLDER IS A VETERAN OF THE UNITED STATES ARMED FORCES PURSUANT TO PARA- GRAPH (B) OF SUBDIVISION THREE OF SECTION FOUR HUNDRED NINETY OF THIS ARTICLE. S 2. Subparagraph (ii) of paragraph (d) of subdivision 2 of section 503 of the vehicle and traffic law, as amended by chapter 55 of the laws of 1992, is amended to read as follows: (ii) If a knowledge test or [test] TESTS are required to be passed to secure an amended learner's permit or license, the fees for taking of such test or tests specified in paragraph (a) of this subdivision shall be paid. However, if an amendment is to add only an endorsement or endorsements which require only the passing of a knowledge test or tests, a fee of five dollars shall be paid. If a road test or tests are required to be passed to secure an amended license, the fees for taking such test or tests specified in paragraph (b) of this subdivision shall be paid. If no knowledge or road test is required to secure an amended license, the fee required for such amended license shall be five EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
