BILL NUMBER:S5965 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to authorizing the department of motor vehicles to issue drivers' licenses to certain aliens PURPOSE: To facilitate road safety and accountability by providing immigrants with New York State drivers licenses. SUMMARY OF PROVISIONS: Section 1 authorizes the department of motor vehicles to issue drivers licenses to certain foreign nationals and establishes the eligibility requirements including: The identification documentation which will be required for a threshold showing of eligibility as well as documentation necessary to show state residency. This section also provides that an individual who has been convicted or is wanted for a felony crime shall not be eligible. It also requires that the department not issue or renew the license of an individual who has been convicted of a felony crime in the United States or abroad. Finally, this section requires that the department revoke such a license if it is determined that the individual is no longer entitled to such a license.

The vehicle and traffic law is amended by adding a new section 503-a to read as follows: S 503-A. DRIVERS' LICENSES FOR FOREIGN NATIONALS. 1. THE DEPARTMENT SHALL, SUBJECT TO THE REQUIREMENTS OF THIS SECTION, ISSUE A DRIVER'S LICENSE TO A FOREIGN NATIONAL WHO IS AN APPLICANT FOR A DRIVER'S LICENSE AND WHO MEETS THE APPLICABLE REQUIREMENTS OF THIS CHAPTER BUT WHO IS UNABLE TO SATISFY THE FORMS FOR PROOF OF IDENTITY PRESCRIBED IN SECTION FIVE HUNDRED TWO OF THIS ARTICLE. 2. TO BE ELIGIBLE FOR A DRIVER'S LICENSE UNDER THIS SECTION, THE APPLICANT MUST: (A)(I) PRESENT TO THE DEPARTMENT A VALID PASSPORT ISSUED TO THE APPLI- CANT BY HIS OR HER COUNTRY OF CITIZENSHIP, A CURRENT IDENTIFICATION CARD ISSUED TO THE APPLICANT BY THE EMBASSY OR CONSULATE IN THE UNITED STATES OF HIS OR HER COUNTRY OF CITIZENSHIP, OR A CONSULAR REPORT OF THE APPLI- CANT'S BIRTH. (II) THE DEPARTMENT SHALL PROVIDE FOR THE ACCEPTANCE OF ALTERNATIVE FORMS OF IDENTIFICATION TO THE IDENTIFICATION REQUIRED UNDER SUBPARA- GRAPH (I) OF THIS PARAGRAPH INCLUDING A VALID, UNEXPIRED MOTOR VEHICLE OPERATOR'S LICENSE ISSUED BY ANOTHER STATE OR COUNTRY, A VALID FOREIGN VOTER REGISTRATION CARD, A CERTIFIED COPY OF A MARRIAGE CERTIFICATE ISSUED WITHIN THE UNITED STATES, A CERTIFIED SCHOOL TRANSCRIPT AND A BAPTISMAL CERTIFICATE OR OTHER SIMILAR DOCUMENT; (B) SUBMIT PROOF, TO THE SATISFACTION OF THE DEPARTMENT, OF AN ESTAB- LISHED RESIDENCY IN THIS STATE FOR AT LEAST SIX MONTHS DURING THE FIVE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. BILL NUMBER:S5965B TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to authorizing the department of motor vehicles to issue limited purpose drivers' licenses PURPOSE: To improve public safety and expand economic opportunity by allowing individuals who cannot provide the documentation necessary to obtain a standard or enhanced driver's license the chance to earn a limited purpose driver's license. SUMMARY OF PROVISIONS: Section 1 adds section 503-A to the vehicle and traffic law, providing for the creation and implementation of Limited Purpose Drivers' Licenses in New York. Paragraph 1 directs the department to provide limited purpose drivers' licenses to qualified individuals. Paragraph 2 sets forth the necessary proofs of identity and residency an applicant must show in order to obtain a limited purpose driver's license. Paragraph 3 sets forth the duration for which limited purpose drivers' licenses shall be valid.
