BILL NUMBER:S6233 TITLE OF BILL: An act to amend the state finance law, the tax law, and the public health law, in relation to the approval of the disposition of the New York state prostate cancer research, detection and education fund PURPOSE OR GENERAL IDEA OF BILL: To promote the prompt and efficient allocation of funds raised by the New York State Prostate Cancer Research, Detection and Education Fund to fight prostate cancer through education and research. SUMMARY OF SPECIFIC PROVISIONS: Section 1 -- Amends section 95-e of the State Finance Law a. to renumber it as section 95-h b. makes a technical amendment to correct section 209-e to section 209-E of section 630 of the Tax Law c. provides that 10% of the funds raised will be allocated to cancer centers designated as comprehensive by the National Institutes of Health operating in New York State for education, advertising and outreach

RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, the tax law, and the public health law, in relation to the approval of the disposition of the New York state prostate cancer research, detection and education fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 95-e of the state finance law, as added by chapter 273 of the laws of 2004 and subdivision 2 as amended by section 1 of part A of chapter 58 of the laws of 2004, is amended to read as follows: [S 95-e.] S 95-H. New York state prostate cancer research, detection and education fund. 1. There is hereby established in the joint custody of the commissioner of taxation and finance and the comptroller, a special fund to be known as the "New York state prostate cancer research, detection and education fund". 2. Such fund shall consist of all revenues received pursuant to the provisions of sections two hundred nine-E and six hundred thirty of the tax law, all revenues received pursuant to appropriations by the legis- lature, and all moneys appropriated, credited, or transferred thereto from any other fund or source pursuant to law. For each state fiscal year, there shall be appropriated to the fund by the state, in addition to all other moneys required to be deposited into such fund, an amount equal to the amounts of monies collected and deposited into the fund pursuant to sections [two hundred nine-e] TWO HUNDRED NINE-E and six hundred thirty of the tax law during the preceding calendar year, as certified by the comptroller. Nothing contained herein shall prevent the state from receiving grants, gifts or bequests for the purposes of the fund as defined in this section and depositing them into the fund according to law. Any interest received by the comptroller on moneys on deposit in such fund shall be retained in and become part of such fund. 3.
