Provides that the commissioner of health shall not issue, renew or amend any operating certificate for Glen Cove hospital that will result in the removal, elimination or substantial change in capacity of services at such hospital unless there is a public hearing where it is determined that removal, elimination or substantial change shall not have a negative effect on Glen Cove hospital.

BILL NUMBER:S6314 TITLE OF BILL: An act in relation to the issuance of an amended operating certificate for Glen Cove Hospital PURPOSE: This legislation would prohibit the Commissioner of the Department of Health from amending Glen Cove Hospital's operative certificate with respect to the elimination, removal or substantial change in orthopedic services offered without conducting a public hearing.. SUMMARY OF PROVISIONS: Section 1: the Commissioner of Health shall not issue, renew or amend any operating certificate for Glen Cove hospital, Nassau County, that will result in the removal, elimination or substantial change in capacity of orthopedic services at such hospital without conducting a public hearing in the community affected by such changes. JUSTIFICATION: Glen Cove Hospital has offered first rate orthopedic care to Long Island patients. Furthermore, there has been no evidence released that demonstrates the hospital is not financially viable. This legislation will prohibit the removal or transfer of orthopedic services from Glen Cove Hospital without a public hearing in Glen Cove.

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT in relation to the issuance of an amended operating certificate for Glen Cove Hospital THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, rule or regu- lation to the contrary, the commissioner of health shall not issue, renew or amend any operating certificate for Glen Cove hospital, Nassau county, that will result in the removal, elimination or substantial change in capacity of orthopedic services at such hospital unless after a public hearing, convened by the commissioner of health and held within the community served by Glen Cove hospital, a determination and findings are made that the removal, elimination or substantial change in capacity of orthopedic services at such hospital shall not have a negative effect on Glen Cove hospital and the community served by such hospital.
