BILL NUMBER:S6747 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to exempting certain premises in the county of Warren from the prohibition on manufacturers and wholesalers having an interest in premises selling alcoholic beverages at retail PURPOSE: Exempts certain premises in the county of Warren from the prohibition on manufacturers having an interest in premises selling alcoholic beverages at retail. SUMMARY OF PROVISIONS: Amends sections 101(1)(a) and 106(13) of the Alcoholic Beverage Control Law, which restricts the relationships between manufactures, wholesalers and retailers, by adding two parcels of land in the Town of Queensbury and the City of Glens Falls. EXISTING LAW: Current law restricts ownership interests between alcohol manufacturers, wholesalers and retailers. However, over the years the law has been amended to create specific exemptions from theses general prohibitions.
JUSTIFICATION: The craft-brewing industry is experiencing unprecedented growth and Davidson Brothers located in Glens Falls, New York is a perfect example of this growth. For the past 16 years Davidson Brothers has been operating its 7 barrel brewery in the City of Glens Falls and have a contract brewery in Portland, Maine which produces their bottled beer for retail sale. The Davidson Brothers brand has built a strong presence in New York's distribution markets but has limited growth potential due to production capacity limits of their existing 7 barrel brewery in Glens Falls. Their current location is in the center of the historic downtown district of Glens Falls and the new 50 barrel traditional Peter Austin system will be developed in an existing vacant structure the in Town Queensbury. Both breweries will supply their current market as well as be able to produce product to ship out of the market areas for Davidson Brothers and other contract customers. LEGISLATIVE HISTORY: New Bill. LOCAL FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately.

LITTLE -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to exempting certain premises in the county of Warren from the prohibi- tion on manufacturers and wholesalers having an interest in premises selling alcoholic beverages at retail THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 1 of section 101 of the alco- holic beverage control law, as amended by chapter 22 of the laws of 2011, is amended to read as follows: (a) Be interested directly or indirectly in any premises where any alcoholic beverage is sold at retail; or in any business devoted wholly or partially to the sale of any alcoholic beverage at retail by stock ownership, interlocking directors, mortgage or lien or any personal or real property, or by any other means. The provisions of this paragraph shall not apply to (i) any such premises or business constituting the overnight lodging and resort facility located wholly within the bounda- ries of the town of North Elba, county of Essex, township eleven, Richard's survey, great lot numbers two hundred seventy-eight, two hundred seventy-nine, two hundred eighty, two hundred ninety-eight, two hundred ninety-nine, three hundred, three hundred eighteen, three hundred nineteen, three hundred twenty, three hundred thirty-five and three hundred thirty-six, and township twelve, Thorn's survey, great lot numbers one hundred six and one hundred thirteen, as shown on the Adirondack map, compiled by the conservation department of the state of New York - nineteen hundred sixty-four edition, in the Essex county atlas at page twenty-seven in the Essex county clerk's office, Eliza- bethtown, New York, provided that such facility maintains not less than two hundred fifty rooms and suites for overnight lodging[,]; (ii) any such premises or business constituting the overnight lodging and resort facility located wholly within the boundaries of that tract or parcel of land situate in the city of Canandaigua, county of Ontario, beginning at EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
