BILL NUMBER:S7079 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to requiring drivers to reduce their speed when driving by sanitation workers PURPOSE: Requires drivers to reduce their speed when approaching and passing sanitation workers engaged in performing their duties. SUMMARY OF PROVISIONS: Section one of this bill amends the Vehicle and Traffic Law by adding section 141-b which defines a Sanitation worker as a person engaged in the collection and transportation of solid waste and recyclables. Section two amends section 1180 (e) of the Vehicle and Traffic Law by requiring vehicles to reduce speed when approaching sanitation workers. Section three has this act taking effect immediately. JUSTIFICATION: According to the 2009 Bureau of Labor Statistics sanitation workers who collect refuse and recyclables has the 7th most dangerous job. The dangers of sanitation work are vast but some of these dangers are avoidable. In October of 2013 a sanitation worker was killed by a motor vehicle while performing his duties in the Town

HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring drivers to reduce their speed when driving by sanitation workers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 141-b to read as follows: S 141-B. SANITATION WORKER. A PERSON ENGAGED IN THE COLLECTION AND TRANSPORT OF SOLID WASTE AND RECYCLABLES. S 2. Subdivision (e) of section 1180 of the vehicle and traffic law, as amended by chapter 465 of the laws of 2010, is amended to read as follows: (e) The driver of every vehicle shall, consistent with the require- ments of subdivision (a) of this section, drive at an appropriate reduced speed when approaching and crossing an intersection or railway grade crossing, when approaching and going around a curve, when approaching a hill crest, when approaching and passing by an emergency situation involving any authorized emergency vehicle which is parked, stopped or standing on a highway and which is displaying one or more red or combination red, white, and/or blue lights pursuant to the provisions of paragraph two and subparagraph b of paragraph four of subdivision forty-one of section three hundred seventy-five of this chapter, when traveling upon any narrow or winding roadway, and when any special hazard exists with respect to pedestrians, SANITATION WORKERS, or other traffic by reason of weather or highway conditions, including, but not limited to a highway construction or maintenance work area.
