BILL NUMBER:S7239 TITLE OF BILL: An act to amend the public authorities law, in relation to energy audits PURPOSE OR GENERAL IDEA OF BILL: Eliminates certain fees associated with on-bill recovery financing through the "Green Jobs/Green New York" Program. SUMMARY OF SPECIFIC PROVISIONS: Section One: Amends subdivision 3 of section 1395 of the public authorities law waiving certain fees associated with on-bill recovery financing through the "Green Jobs/Green New York" Program for those eligible for free or reduced cost energy audits. Section Two: Sets effective date. JUSTIFICATION: Promoting energy conservation and clean energy technologies is a responsible approach for reducing emissions of potentially harmful air contaminants and for creating opportunities for "green jobs" in the marketplace to improve competition and enhance our economy. On bill financing enhances the Green Jobs Green New York Program by allowing electric and gas utilities to offer energy efficiency loans to be paid back on utility bills. MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public authorities law, in relation to energy audits THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 1895 of the public authorities law, as added by chapter 487 of the laws of 2009, is amended to read as follows: 3. The authority shall establish a schedule of fees for energy audits based on the type and nature of the energy audit and other relevant considerations. The schedule shall include a sliding scale which provides that audit fees AND FEES AUTHORIZED PURSUANT TO SUBPARAGRAPHS (VI) AND (VII) OF PARAGRAPH (C) OF SUBDIVISION ONE OF SECTION EIGHTEEN HUNDRED NINETY-SIX OF THIS TITLE shall be waived for residential appli- cants whose demonstrated income is less than two times the median county household income, and the full fees shall be paid by applicants whose median county household income is not less than four times the median county household income. Applicants whose demonstrated incomes fall between these levels shall pay a pro rata percentage of the audit fees. The authority may provide for discounted fees for small businesses or not-for-profit corporations with ten or fewer employees. S 2. This act shall take effect immediately.
