BILL NUMBER:S7366 TITLE OF BILL: An act to amend the village law, in relation to author- izing villages to sell or lease advertising space on village property PURPOSE: To expand the powers of village trustees to allow for the sale or leas- ing of advertising space on village property. SUMMARY OF PROVISIONS: This legislation would add a new paragraph (14) to subdivision 3 of section 4-412 of the village law. JUSTIFICATION: It has been held that without express statutory authority , villages may not raise revenues by selling advertising space on municipal property. As villages have been struggling to maintain services and at the same time contain increases in real property taxes, this amendment would give the village trustees an option to realize additional funds without increasing taxes. THIELE -- read once and referred to the Committee on Local Governments AN ACT to amend the village law, in relation to authorizing villages to sell or lease advertising space on village property THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 4-412 of the village law is amended by adding a new paragraph 14 to read as follows: (14) ADVERTISING. MAY SELL OR LEASE TO ANY PERSON, FIRM, CORPORATION OR OTHER BUSINESS ENTITY, FOR COMMERCIAL OR PRIVATE USE, ADVERTISING SPACE ON VILLAGE PROPERTY. S 2. This act shall take effect immediately.
