BILL NUMBER:S872 TITLE OF BILL: An act to amend the environmental conservation law and the state finance law, in relation to the collection of drink containers for recycling on state property PURPOSE: To ensure the full collection of recyclable material on state property. SUMMARY OF SPECIFIC PROVISIONS: Adds a new paragraph to subdivision 1 of section 27-0717 of the environmental conservation law to require the Department of Environmental Conservation to cooperate and advise other state agencies in implementing this act to ensure compliance and full collection of recyclables on state property. Adds a new paragraph to subdivision 3 of section 165 of the state finance law to include the provision that for every four waste receptacles, at least one receptacle for drink containers must be made available. Includes the definition of "drink container" as an individual glass, metal, steel or plastic bottle used to contain up to one gallon of a drink.

GRISANTI, MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Environ- mental Conservation AN ACT to amend the environmental conservation law and the state finance law, in relation to the collection of drink containers for recycling on state property THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 27-0717 of the environmental conservation law is amended by adding a new paragraph (e) to read as follows: (E) COOPERATE WITH AND ADVISE OTHER STATE AGENCIES IN IMPLEMENTING PARAGRAPH F OF SUBDIVISION THREE OF SECTION ONE HUNDRED SIXTY-FIVE OF THE STATE FINANCE LAW TO ENSURE COMPLIANCE AND FULL COLLECTION OF RECYCLABLE MATERIAL ON STATE PROPERTY. S 2. Paragraph f of subdivision 3 of section 165 of the state finance law, as amended by chapter 95 of the laws of 2000, is amended to read as follows: f. Each state agency shall devise and institute a program to source separate all other waste generated within state office facilities that is not covered by paragraph e of this subdivision. Such program shall include marketing arrangements and appropriate procedures to ensure the maximum recovery of such waste. THE STATE SHALL ENSURE FOR EVERY FOUR WASTE RECEPTACLES THE AVAILABILITY OF AT LEAST ONE RECEPTACLE FOR THE COLLECTION OF DRINK CONTAINERS TO PROMOTE RECYCLING AND MAXIMUM RECOV- ERY. THE TERM "DRINK CONTAINER" SHALL MEAN AN INDIVIDUAL GLASS, METAL, STEEL, OR PLASTIC BOTTLE, CAN OR JAR USED FOR CONTAINING UP TO ONE GALLON OF A DRINK. S 3. This act shall take effect on the one hundred twentieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
