S T A T E O F N E W Y O R K ________________________________________________________________________ 10028 I N A S S E M B L Y June 10, 2014 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Rodriguez) -- read once and referred to the Committee on Housing AN ACT to amend the administrative code of the city of New York, in relation to scaffolding permit renewals THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The administrative code of the city of New York is amended by adding a new section 3314.20 to the New York City building code to read as follows: 3314.20 NO SCAFFOLDING PERMIT ISSUED FOR CONSTRUCTION PROJECTS ON PUBLIC HOUSING DEVELOPMENTS PROVIDED BY THE NEW YORK CITY HOUSING AUTHORITY SHALL BE RENEWED UNLESS THE COMMISSIONER DETERMINES THAT SUCH SCAFFOLDING IS BEING USED AS PART OF AN ONGOING CONSTRUCTION PROJECT. THE COMMISSIONER SHALL PROMULGATE SUCH RULES AND REGULATIONS AS SHALL BE NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION. AN "ONGOING CONSTRUCTION PROJECT" SHALL MEAN ANY CONSTRUCTION PROJECT DURING WHICH PERSONS EMPLOYED IN CONSTRUCTION WORK ARE UTILIZING SUCH SCAFFOLDING AT LEAST TWO DAYS PER WEEK, OR HAVE UTILIZED SUCH SCAFFOLD- ING FOR AT LEAST TWO DAYS PER WEEK AT ANY TIME OVER THE COURSE OF THE SIX MONTHS IMMEDIATELY PRECEDING A REQUEST TO RENEW A SCAFFOLDING PERMIT. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
