COLTON -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to making incest a class B felony THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The second undesignated paragraph of section 255.25 of the penal law, as amended by chapter 320 of the laws of 2006, is amended to read as follows: Incest in the third degree is a class [E] B felony. S 2. The second undesignated paragraph of section 255.26 of the penal law, as added by chapter 320 of the laws of 2006, is amended to read as follows: Incest in the second degree is a class [D] B felony. S 3. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD00497-01-3
