BARCLAY, CROUCH, GIGLIO, JORDAN -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to adding by means of comput- er network to the crime of aggravated harassment in the second degree THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 240.30 of the penal law, as amended by chapter 510 of the laws of 2008, is amended to read as follows: 1. Either (a) communicates with a person, anonymously or otherwise, by telephone, by telegraph, or by mail, or by transmitting or delivering any other form of written communication, in a manner likely to cause annoyance or alarm; or (b) causes a communication to be initiated by mechanical or electronic means OR COMPUTER NETWORK, AS DEFINED IN SUBDIVISION SIX OF SECTION 156.00 OF THIS CHAPTER, or otherwise with a person, anonymously or otherwise, by telephone, by telegraph, or by mail, or by transmitting or delivering any other form of written communication, in a manner likely to cause annoyance or alarm; or S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
