CERETTO, GOTTFRIED, HOOPER, JAFFEE, SKARTADOS -- read once and referred to the Committee on Economic Development AN ACT to amend the general business law, in relation to requiring all cellular telecommunications service providers with new cellular anten- na towers to secure on-site back-up power THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 390-d to read as follows: S 390-D. ON-SITE BACK-UP POWER SOURCE REQUIRED FOR NEW CELLULAR ANTEN- NA TOWERS. ON OR BEFORE JANUARY FIRST, TWO THOUSAND FOURTEEN, EACH CELLULAR TELECOMMUNICATIONS SERVICE PROVIDER WITH A NEW CELLULAR ANTENNA TOWER SHALL EQUIP SUCH TOWER WITH ON-SITE BACK-UP POWER CAPABLE OF PROVIDING ELECTRICAL POWER CONTINUOUSLY FOR A MINIMUM OF SEVENTY-TWO HOURS TO BE USED DURING A POWER FAILURE.
