CRESPO -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to requiring the commis- sioner of education to promulgate rules and regulations requiring that all students in grade five or below remain at their school unless they are under the supervision of authorized transportation, a parent or guardian or another authorized person THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 43 to read as follows: 43. THE COMMISSIONER IS AUTHORIZED AND DIRECTED TO PROMULGATE RULES AND REGULATIONS WHICH REQUIRE THAT ALL STUDENTS WHO ARE IN GRADE FIVE OR BELOW AND WHO ARE ATTENDING SCHOOL ON A PARTICULAR DAY SHALL REMAIN AT THEIR SCHOOL BUILDING UNLESS THEY ARE RELEASED UNDER THE SUPERVISION OF AUTHORIZED TRANSPORTATION, A PARENT OR GUARDIAN OR ANOTHER AUTHORIZED PERSON. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD00621-01-3
