HEVESI, ROSENTHAL, COLTON -- read once and referred to the Committee on Energy AN ACT to amend the public authorities law and the New York state urban development corporation act, in relation to requiring organizations that receive funds for capital improvements by the New York state dormitory authority and the urban development corporation to use such funds for the purchase of energy star equipment and appliances where available THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public authorities law is amended by adding a new section 1680-q to read as follows: S 1680-Q. CAPITAL IMPROVEMENT FUNDING. 1. ANY FUNDS ADMINISTERED BY THE DORMITORY AUTHORITY TO AN ORGANIZATION FOR THE PURPOSES OF BUILDING UPGRADES, APPLIANCE PURCHASES, OR OTHER CAPITAL IMPROVEMENTS, SHALL BE USED TO PURCHASE ONLY ENERGY STAR EQUIPMENT AND APPLIANCES, WHERE AVAIL- ABLE. 2. FOR THE PURPOSES OF THIS SECTION, THE TERM "ENERGY STAR" SHALL MEAN A DESIGNATION FROM THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY OR DEPARTMENT OF ENERGY INDICATING THAT A PRODUCT MEETS THE ENERGY EFFI- CIENCY STANDARDS SET FORTH BY THE AGENCY FOR COMPLIANCE WITH THE ENERGY STAR PROGRAM. S 2. Section 1 of chapter 174 of the laws of 1968, constituting the New York state urban development corporation act, is amended by adding a new section 16-v to read as follows: S 16-V. CAPITAL IMPROVEMENT FUNDING. 1. ANY FUNDS ADMINISTERED BY THE CORPORATION TO AN ORGANIZATION FOR THE PURPOSES OF BUILDING UPGRADES, APPLIANCE PURCHASES, OR OTHER CAPITAL IMPROVEMENTS, SHALL BE USED TO PURCHASE ONLY ENERGY STAR EQUIPMENT AND APPLIANCES, WHERE AVAILABLE.
