COOK -- Multi-Sponsored by -- M. of A. CLARK, COLTON, GOTTFRIED, SWEENEY -- read once and referred to the Committee on Insurance AN ACT to amend the insurance law, in relation to prohibiting duplicate coverage relative to long term health care policies THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1117 of the insurance law is amended by adding a new subsection (h) to read as follows: (H) NO POLICY OF INSURANCE COVERING LONG TERM CARE ISSUED SUBJECT TO THE PROVISIONS OF THIS SECTION SHALL PROVIDE ANY TYPE OF COVERAGE TO AN INSURED WHICH THE INSURED ALREADY HAS IN FORCE AND EFFECT AT THE TIME OF EXECUTION OF SUCH A POLICY COVERING LONG TERM CARE.
