S T A T E O F N E W Y O R K ________________________________________________________________________ 8273 2013-2014 Regular Sessions I N A S S E M B L Y November 20, 2013 ___________ Introduced by M. of A. SCARBOROUGH -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to unlawfully buying or sell- ing a child THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 260.07 to read as follows: S 260.07 UNLAWFULLY BUYING OR SELLING A CHILD. 1. IT SHALL BE UNLAWFUL FOR ANY PERSON TO SELL OR PURCHASE A MINOR CHILD. 2. IT SHALL NOT BE A VIOLATION OF THIS SECTION IF THE ONLY CONSIDER- ATION PAID BY THE PERSON RECEIVING OR TO RECEIVE THE CHILD IS INTENDED TO PAY FOR THE PRENATAL HOSPITAL OR MEDICAL EXPENSES INVOLVED IN THE BIRTH OF THE CHILD, OR ATTORNEYS' FEES AND COURT COSTS INVOLVED IN EFFECTUATING TRANSFER OF CHILD CUSTODY CONSISTENT WITH THE PROVISIONS OF SUBDIVISION SIX OF SECTION THREE HUNDRED SEVENTY-FOUR OF THE SOCIAL SERVICES LAW. UNLAWFULLY BUYING OR SELLING A CHILD IS A CLASS B FELONY. S 2. This act shall take effect immediately.
