ROZIC -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the request by parents for translated documents for students with disabilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 4403 of the education law is amended by adding a new subdivision 21 to read as follows: 21. TO PROVIDE ANY PARENT OR PERSON IN PARENTAL RELATION WITH A STUDENT WITH A DISABILITY AS DEFINED PURSUANT TO SUBDIVISION ONE OF SECTION FORTY-FOUR HUNDRED ONE OF THIS ARTICLE, ALL EVALUATIONS, INDI- VIDUALIZED EDUCATION PROGRAMS, AND IMPLEMENTATION PLANS TRANSLATED INTO THEIR PRIMARY LANGUAGE AT THE REQUEST OF SUCH PARENT. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14714-02-4

SUCH PARENT OR PERSON IN PARENTAL RELATION MUST COMPLETE AND SUBMIT A FORM TO THE DEPARTMENT, PROVIDED BY THE DEPARTMENT, WHICH SHALL RELEASE SUCH DOCUMENTS IN COMPLIANCE WITH APPLICABLE STATE AND FEDERAL PRIVACY LAWS FOR THE PURPOSES OF TRANSLATIONS. SUCH FORMS SHALL BE ISSUED BY THE DEPARTMENT AND MADE AVAILABLE TO SCHOOLS UPON REQUEST AND PUBLISHED ON THE DEPART- MENT'S WEBSITE. S 2. This act shall take effect immediately.
