BILL NUMBER:S1124 TITLE OF BILL: CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to article 17 of the constitution, in relation to a residency period prior to receipt of certain social services SUMMARY OF PROVISIONS: Section 1 provides that Article 17 of the Constitution be amended by adding a new Section 8 which provides that the Legislature may direct the state, a municipality or other entity acting as an instrumentality of the state or a municipality to require a specific period of residency within the state as a prerequisite to any person seeking the provision of such services set forth in Article 17. Section 2 would provide for submission of this constitutional amendment to the first Regular Session of the Legislature after the next succeeding general election of the members of the Assembly. PURPOSE AND JUSTIFICATION: New York has one of the most generous Medicaid and social service programs in the United States. Resolved (if the Assembly concur), That article 17 of the constitution be amended by adding a new section 8 to read as follows: S 8. NOTWITHSTANDING ANY OTHER PROVISION OF THIS CONSTITUTION, THE LEGISLATURE MAY DIRECT THE STATE, A MUNICIPALITY OR OTHER ENTITY ACTING AS AN INSTRUMENTALITY OF THE STATE OR A MUNICIPALITY, TO REQUIRE A SPECIFIC PERIOD OF RESIDENCY WITHIN THE STATE AS A PREREQUISITE TO ANY PERSON SEEKING THE PROVISION OF SUCH SERVICES SET FORTH IN THIS ARTICLE. S 2. Resolved (if the Assembly concur), That the foregoing amendment be referred to the first regular legislative session convening after the next succeeding general election of members of the assembly, and, in conformity with section 1 of article 19 of the constitution, be published for 3 months previous to the time of such election.
