BILL NUMBER:S2979 TITLE OF BILL: An act to amend the racing, pari-mutuel wagering and breeding law, in relation to internet video displays of horse racing PURPOSE: This bill would enact into law recommendation number six from the Task Force on the Future of Off-Track Betting In New York State. Specifically, the bill would amend RWL . 1003 regarding in-home simul- casting to make clear that the display of live horse racing over the internet be exempted from said provisions. SUMMARY OF PROVISIONS: Section 1 - Amends section 1003 of the simulcasting provisions of the RWL by adding a new subdivision (6) regarding internet video displays of horse racing. Section 2 - This act shall take effect immediately. EXISTING LAW: The current section, when enacted did not address inter- net video streaming of horse racing because at the time this technology was not in existence. JUSTIFICATION: The current statute did not contemplate internet use for simulcasting and creates an undue burden on the tracks and OTBs while frustrating bettors and fans. ADAMS -- read twice and ordered printed, and when printed to be committed to the Committee on Racing, Gaming and Wager- ing AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to internet video displays of horse racing THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1003 of the racing, pari-mutuel wagering and breed- ing law is amended by adding a new subdivision 6 to read as follows; 6. IN-HOME SIMULCASTING, AS AUTHORIZED PURSUANT TO SUBDIVISION ONE OF THIS SECTION, SHALL NOT BE DEFINED TO INCLUDE INTERNET VIDEO DISPLAYS OF HORSE RACING. NOTHING IN THIS SECTION SHALL BE CONSTRUED TO PREVENT RACING ASSOCIATIONS OR CORPORATIONS FROM DISPLAYING LIVE INTERNET VIDEO OF THEIR RACES ON THEIR INDIVIDUAL WEBSITES. S 2.
