BILL NUMBER:S4477 TITLE OF BILL: An act to authorize the commissioner of the office of general services to execute and deliver a release to the city of Oneonta with respect to certain lands PURPOSE: To release the city of Oneonta from the state of New York's restriction of use of a certain parcel of land. SUMMARY OF PROVISIONS: Section one - establishes a release reversion clause, authorizing the release of land obtained by the city of Oneonta in 2004. Such release extinguishes the reversionary interest of the state of New York and does not restrict the lawful use of the property by the city of Oneonta. Section two - provides the effective date. JUSTIFICATION: This bill comes as a home rule request from the City of Oneonta. The city obtained the former New York State Armory in 2004 from the State of New York, now known as the Asa Allison municipal recreation

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize the commissioner of the office of general services to execute and deliver a release to the city of Oneonta with respect to certain lands THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any inconsistent provision of law to the contrary, the commissioner of the office of general services is author- ized to execute and deliver a release to the city of Oneonta with respect to land conveyed to the city of Oneonta from the state of New York by letters patent dated January 28, 2004 and recorded in the Otsego county clerk's office on February 18, 2004 in Liber 1034 of Deeds at Page 336. Such release shall extinguish the reversionary interest of the state of New York in such land as provided for in such letters patent as required by section 34 of the public lands law. Such release shall not provide for any reservation, limitation or condition of any kind which would restrict the lawful use of such property by the city of Oneonta. The commissioner shall file a copy of the release, along with an offi- cial copy of this act, with the secretary of state. S 2. This act shall take effect immediately.
