BILL NUMBER:S6709 TITLE OF BILL: An act to authorize the governor to enter into an agreement with the state of New Jersey and apply to the Congress of the United States for its consent and approval, relating to requiring the port authority of New York and New Jersey to provide advance notice of any project or operation which is expected to impede the flow of traffic PURPOSE: Provides for the provision of prior notice by the Port Authority of New York and New Jersey of any project or operation that will impede the free flow of traffic on or near and authority facility. SUMMARY OF PROVISIONS: Section one of the bill state that the governor is authorized to enter into a supplemental agreement, on behalf of the state, with the state of New Jersey, in accordance with chapter 154 of the laws of 1921 to implement the provisions of section three of this act. Section two of the bill authorizes the governor to apply, on behalf of the state to the Congress of the United States for its consent and approval of the amendments to the compact between the state and the state of New Jersey. LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to authorize the governor to enter into an agreement with the state of New Jersey and apply to the Congress of the United States for its consent and approval, relating to requiring the port authority of New York and New Jersey to provide advance notice of any project or operation which is expected to impede the flow of traffic THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The governor is authorized to enter into a supplemental compact or agreement, on behalf of the state, with the state of New Jersey amending the compact between this state and the state of New Jersey establishing the port of New York authority, in accordance with chapter 154 of the laws of 1921, as amended and supplemented, to imple- ment the provisions of section three of this act. S 2. The governor is authorized to apply, on behalf of the state, to the Congress of the United States for its consent and approval of the amendments to the compact between the state and the state of New Jersey, establishing the port of New York authority, proposed in section three of this act. Provided, however, that in the absence of the consent and approval of the Congress, the port authority of New York and New Jersey shall retain all of the powers which this state and the state of New Jersey may confer upon such authority without such consent and approval. S 3. The port authority of New York and New Jersey shall provide advance notice of any planned project or operation which is expected to impede the free flow of traffic on or near any port authority facility by: a. providing advance written notice to the mayor and municipal emer- gency management coordinator in every municipality within five miles of the facility; b. providing advance notification of the project or operation to news- papers of general circulation in each county and municipality in which the transportation facility is located; and EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
