BILL NUMBER:S7383 TITLE OF BILL: An act to amend the mental hygiene law, in relation to the prescription of certain medications which have an increased risk of suicidal behavior PURPOSE: Provides that no medication prescribed in this state which has an increased risk of suicidal behavior in individuals shall be dispensed without consultation and other information. SUMMARY OF PROVISIONS: Section 1 is amended by adding a new section 7.45, to include several instructions regarding the dispensing of a medication with suicidal tendencies as an undesired side effect. During the required consulta- tion, pharmacists will provide literature with the toll-free suicide prevention telephone number, suicide prevention website and an informa- tion pamphlet drafted by the Department of Mental Health. Other provisions include: Requirement of parent or guardian if prescribed patient is under 17 and permission to the Department to regu- late and prepare all material. Section 2: Effective Date.

TKACZYK -- read twice and ordered printed, and when printed to be committed to the Committee on Mental Health and Develop- mental Disabilities AN ACT to amend the mental hygiene law, in relation to the prescription of certain medications which have an increased risk of suicidal behav- ior THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The mental hygiene law is amended by adding a new section 7.45 to read as follows: S 7.45 PRESCRIPTION MEDICATIONS; SUICIDE RISK. (A) NO PRESCRIPTION MEDICATION PRESCRIBED IN THIS STATE WHICH HAS AN INCREASED RISK OF SUICIDAL BEHAVIOR IN INDIVIDUALS AND IS REQUIRED BY THE FEDERAL DRUG ADMINISTRATION TO BE PRESCRIBED WITH A BLACK BOX LABEL WARNING SHALL BE DISPENSED, DISPERSED OR OTHERWISE GIVEN TO ANY PERSON, UNLESS THE PERSON FOR WHOM SUCH PRESCRIPTION WAS WRITTEN HAS: (1) CONSULTED WITH THE PHARMACIST DISPENSING SUCH MEDICATION REGARDING THE INCREASED RISK OF SUICIDE AND SUICIDAL SIDE EFFECTS ASSOCIATED WITH THE DRUG; (2) RECEIVED THE TOLL-FREE SUICIDE PREVENTION LIFELINE TELEPHONE NUMBER ESTABLISHED BY THE OFFICE; (3) RECEIVED THE SUICIDE PREVENTION LIFELINE WEBSITE INTERNET ADDRESS ESTABLISHED BY THE OFFICE; AND (4) RECEIVED A PAMPHLET PUBLISHED BY THE OFFICE SETTING FORTH ALL RELEVANT INFORMATION REGARDING THE INCREASED RISK OF SUICIDE AND SUICIDAL SIDE EFFECTS ASSOCIATED WITH THE DRUG, INCLUDING, BUT NOT LIMITED TO, INFORMATION SETTING FORTH THE WARNING SIGNS ASSOCIATED WITH SUCH SUICIDAL BEHAVIOR AND ANY OTHER INFORMATION THE OFFICE DEEMS RELE- VANT. (B) ANY CONSULTATION REQUIRED BY PARAGRAPH ONE OF SUBDIVISION (A) OF THIS SECTION WITH A PERSON SEVENTEEN YEARS OF AGE OR YOUNGER SHALL REQUIRE THAT A PARENT OR LEGAL GUARDIAN OF SUCH PERSON BE IN ATTENDANCE DURING SUCH CONSULTATION. During the required consultation, pharmacists will provide literature with the toll-free suicide prevention telephone number, suicide prevention website and an information pamphlet drafted by the Department of Mental Health.
