BILL NUMBER:S7949 TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to scaffolding permit renewals Purpose: To prevent building scaffolding in New York City Housing Authority (NYCHA) developments from becoming a permanent fixture and perpetual presence-disconnected from realistic construction schedules. Summary of Provisions: This legislation provides that no scaffolding permit shall be renewed by the NYCHA Commissioner except for those associated with an "ongoing construction project." "Ongoing construction project" is defined as a situation characterized by the following conditions: persons employed in construction work are utilizing such scaffolding at least two days a week, or have utilized such scaffolding for at least two days per week at any time over the course of six months immediately preceding a request to renew a scaffolding permit. Justification: As of 2013, the NYCHA had 40.1 miles of sidewalk sheds and associated scaffolds across their 334 developments in New York City. These temporary scaffolds, which are frequently installed when brickwork is pending or being completed on the outside of the structures, have unfortunately become permanent presences and real problems. PERKINS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the administrative code of the city of New York, in relation to scaffolding permit renewals THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The administrative code of the city of New York is amended by adding a new section 3314.20 to the New York City building code to read as follows: 3314.20 NO SCAFFOLDING PERMIT ISSUED FOR CONSTRUCTION PROJECTS ON PUBLIC HOUSING DEVELOPMENTS PROVIDED BY THE NEW YORK CITY HOUSING AUTHORITY SHALL BE RENEWED UNLESS THE COMMISSIONER DETERMINES THAT SUCH SCAFFOLDING IS BEING USED AS PART OF AN ONGOING CONSTRUCTION PROJECT. THE COMMISSIONER SHALL PROMULGATE SUCH RULES AND REGULATIONS AS SHALL BE NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION. AN "ONGOING CONSTRUCTION PROJECT" SHALL MEAN ANY CONSTRUCTION PROJECT DURING WHICH PERSONS EMPLOYED IN CONSTRUCTION WORK ARE UTILIZING SUCH SCAFFOLDING AT LEAST TWO DAYS PER WEEK, OR HAVE UTILIZED SUCH SCAFFOLD- ING FOR AT LEAST TWO DAYS PER WEEK AT ANY TIME OVER THE COURSE OF THE SIX MONTHS IMMEDIATELY PRECEDING A REQUEST TO RENEW A SCAFFOLDING PERMIT.
