AN  ACT  relating  to  permitting  the  continued use of certain outdoor
  advertising signs

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding the provisions of section 88 of the highway
law,  or any regulations adopted pursuant to such law, an outdoor adver-
tising sign shall be allowed to continue to exist if such sign: (i)  was
lawfully  in  existence  prior  to September 1, 1965; (ii) is located in
Montgomery county and is visible from the New York  State  Thruway;  and
(iii) was damaged by bad weather and rebuilt prior to January 1, 2007.
  S 2. This act shall take effect immediately.
