AN ACT to amend the education law, in relation to prohibiting the alter-
  ing of a student's official records, files and/or data

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 9-a of section 225 of  the  education  law,  as
added by chapter 443 of the laws of 1980, is amended to read as follows:
  9-a.    Knowingly  and willfully make an unauthorized and false alter-
ation or representation of any [grade, credit, honor, award or  standing
in  the permanent record or transcript of any student] OFFICIAL RECORDS,
FILES, AND/OR DATA RELATED TO A STUDENT AND MAINTAINED BY  A  SCHOOL  OR
COLLEGE  UNDER  THE SUPERVISION OF THE REGENTS, THE COMMISSIONER, OR THE
UNIVERSITY OF THE STATE OF  NEW  YORK,  INCLUDING  BUT  NOT  LIMITED  TO
RECORDS  ENCOMPASSING  ANY  OF THE MATERIAL KEPT IN THE STUDENT'S RECORD
SUCH AS IDENTIFYING DATA, GRADES, ATHLETIC RECORDS, RECORDS  OF  ATTEND-
ANCE  AND OF ACADEMIC WORK COMPLETED, RECORDS OF STUDENT ACHIEVEMENT AND
ASSESSMENT  RESULTS,  DISCIPLINARY  RECORDS,  INDIVIDUALIZED   EDUCATION
PROGRAMS, OR ANY INFORMATION INCLUDED AS PART OF A STUDENT'S EDUCATIONAL
RECORD  AS  DEFINED  IN SECTION 99.3 OF TITLE THIRTY-FOUR OF THE CODE OF
FEDERAL REGULATIONS  IMPLEMENTING  THE  FAMILY  EDUCATIONAL  RIGHTS  AND
PRIVACY  ACT, SECTION TWELVE HUNDRED THIRTY-TWO-G OF TITLE TWENTY OF THE
UNITED STATES CODE, AS SUCH FEDERAL LAW AND REGULATIONS ARE FROM TIME TO
TIME AMENDED, with respect to a school or college under the  supervision
of  the regents, the commissioner, or the university of the state of New
York.
  S 2. This act shall take effect on the first of July  next  succeeding
the date on which it shall have become a law.
