Provides that rules that require changes to compliance or billing standards that could result in eventual withholdings or takebacks due to Medicaid auditing and/or self-disclosure obligations shall become effective no sooner than ninety days from the publication of adoption of the rules.

AN ACT to amend the state administrative procedure act, in  relation  to
  rule making procedures

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subparagraph (iv) of paragraph  (c)  of  subdivision  5  of
section  202  of  the  state administrative procedure act, as amended by
chapter 610 of the laws of 1987, is amended to read as follows:
  (iv) give the effective date of the  rule,  PROVIDED,  HOWEVER,  THAT,
WITH  RESPECT  TO  RULES  THAT  REQUIRE CHANGES TO COMPLIANCE OR BILLING
STANDARDS THAT COULD RESULT IN EVENTUAL WITHHOLDINGS OR TAKEBACKS DUE TO
MEDICAID AUDITING AND/OR  SELF-DISCLOSURE  OBLIGATIONS,  SUCH  EFFECTIVE
DATE  SHALL  NOT BE SOONER THAN NINETY (90) DAYS FROM THE PUBLICATION OF
THE NOTICE OF ADOPTION OF THE RULE;
  S 2. This act shall take effect on the sixtieth  day  after  it  shall
have become a law.
