RAIA -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to commercial promotional activity in public schools THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2503 of the education law is amended by adding a new subdivision 21 to read as follows: 21. SHALL NOT ENTER INTO WRITTEN OR ORAL CONTRACTS, AGREEMENTS OR ARRANGEMENTS FOR WHICH THE CONSIDERATION, IN WHOLE OR IN PART, CONSISTS OF A PROMISE TO PERMIT COMMERCIAL PROMOTIONAL ACTIVITY ON SCHOOL PREM- ISES UNLESS SUCH COMMERCIAL PROMOTIONAL ACTIVITY IS FOR A SCHOOL PURPOSE AND THE PRIVATE BENEFIT GAINED BY SUCH SCHOOL IS INCIDENTAL RATHER THAN OVERT.
