BUTLER -- read once and referred to the Committee on Consumer Affairs and Protection AN ACT to amend the education law, in relation to certain requirements when substitute drug products are dispensed THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 1 of section 6816-a of the education law, as added by chapter 776 of the laws of 1977, is amended to read as follows: (c) The pharmacist shall indicate on the label affixed to the immedi- ate container in which the drug is sold or dispensed the name and strength of the drug product and its manufacturer unless the prescriber specifically states otherwise, AND SHALL ALSO INDICATE THE BRAND NAME OF THE DRUG PRESCRIBED. The pharmacist shall record on the prescription form the brand name or the name of the manufacturer of the drug product dispensed. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD03545-01-5
