COLTON -- read once and referred to the Committee on Energy AN ACT to amend the energy law, in relation to establishing a one hundred percent energy system by two thousand thirty THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 6-104 of the energy law, as added by chapter 433 of the laws of 2009, is amended to read as follows: 1. The board shall adopt a state energy plan in accordance with the provisions of this article. (A) THE PLAN SHALL: (I) ESTABLISH A GOAL OF ACHIEVING A ONE HUNDRED PERCENT CLEAN ENERGY SYSTEM BY TWO THOUSAND THIRTY, WITH ZERO NET GREENHOUSE GAS EMISSIONS; (II) PROVIDE FOR THE DISCONTINUANCE OF NUCLEAR POWER BY TWO THOUSAND THIRTY; (III) PROVIDE FOR THE DISCONTINUANCE OF STATE INVESTMENT IN, AND THE DEVELOPMENT OF, INFRASTRUCTURE RELATED TO THE DISTRIBUTION, PROCESSING, STORAGE, OR EXTRACTION OF FOSSIL FUELS OR NEW PERMITS RELATED TO SUCH USE; (IV) INCLUDE, IN FIVE YEAR INCREMENTS, DETAILED BENCHMARKS AND STEPS REQUIRED TO ACHIEVE THE GOAL OF A ONE HUNDRED PERCENT CLEAN RENEWABLE ENERGY SYSTEM BY TWO THOUSAND THIRTY; AND (V) INCORPORATE MEASURES RELATED TO REDUCTION IN ENERGY USE, INCREASED ENERGY CONSERVATION, AND IMPROVEMENTS IN ENERGY EFFICIENCY. (B) ANY PROVISIONS OF THIS CHAPTER RELATING TO THE USE OF FOSSIL FUELS, NATURAL GAS, OIL, COAL AND PETROLEUM PRODUCTS SHALL BE IMPLE- MENTED ONLY TO THE EXTENT THAT THEY INCORPORATE THE DISCONTINUED USE OF SUCH FUELS BY TWO THOUSAND THIRTY. (C) THE PROVISIONS OF THIS SUBDIVISION SHALL SUPERSEDE ANY INCONSIST- ENT PROVISIONS CONTAINED IN THIS SECTION. S 2. This act shall take effect on the first of January next succeed- ing the date upon which it shall have become a law; provided, however, that effective immediately, the state energy planning board shall conduct a study to determine the measures necessary to achieve a one hundred percent clean energy system by two thousand thirty.
