OR PREPARATION WHICH CONTAINS ANY QUANTITY OF SYNTHETIC CANNABINOID, OR
WHICH CONTAINS ANY OF ITS SALTS, ISOMERS (WHETHER OPTICAL, POSITIONAL OR
GEOMETRIC), HOMOLOGUES (ANALOGUES), AND SALTS OF ISOMERS AND HOMOLOGUES
(ANALOGUES), WHENEVER THE EXISTENCE OF SUCH SALTS, ISOMERS, HOMOLOGUES
(ANALOGUES) AND SALTS OF ISOMERS AND HOMOLOGUES (ANALOGUES) IS POSSIBLE
WITHIN THE SPECIFIC CHEMICAL DESIGNATION.
(II) FOR THE PURPOSES OF THIS PARAGRAPH, "SYNTHETIC CANNABINOID":
1. MEANS ANY CHEMICAL COMPOUND THAT IS A CANNABINOID RECEPTOR TYPE 1
(CB1 RECEPTOR) AGONIST AS DEMONSTRATED BY BINDING STUDIES AND FUNCTIONAL

21. "KNOWINGLY" FOR THE PURPOSES OF ANY OFFENSE INVOLVING THE
POSSESSION OR SALE, OR THE ATTEMPT OR CONSPIRACY TO POSSESS OR SELL, A
SYNTHETIC CANNABINOID OR SYNTHETIC CATHINONE, SHALL NOT REQUIRE KNOW-
LEDGE BY A PERSON OF THE CHEMICAL STRUCTURE OF THE SUBSTANCE, BUT RATH-
ER, IT IS SUFFICIENT IF:
(A) THE PERSON KNEW OR SHOULD HAVE KNOWN THAT THE SUBSTANCE HAS A
STIMULANT, DEPRESSANT OR HALLUCINOGENIC EFFECT ON THE CENTRAL NERVOUS
SYSTEM THAT IS SUBSTANTIALLY SIMILAR TO OR GREATER THAN THE STIMULANT,
DEPRESSANT OR HALLUCINOGENIC EFFECT ON THE CENTRAL NERVOUS SYSTEM OF A
CONTROLLED SUBSTANCE LISTED IN SCHEDULE I OR II OF SECTION THIRTY-THREE
HUNDRED SIX OF THE PUBLIC HEALTH LAW; OR
(B) THE PERSON REPRESENTED OR INTENDED FOR THE SUBSTANCE TO HAVE A
STIMULANT, DEPRESSANT OR HALLUCINOGENIC EFFECT ON THE CENTRAL NERVOUS
SYSTEM THAT IS SUBSTANTIALLY SIMILAR TO OR GREATER THAN THE STIMULANT,
DEPRESSANT OR HALLUCINOGENIC EFFECT ON THE CENTRAL NERVOUS SYSTEM OF A
CONTROLLED SUBSTANCE LISTED IN SCHEDULE I OR II OF SECTION THIRTY-THREE
HUNDRED SIX OF THE PUBLIC HEALTH LAW.
S 6. Section 220.03 of the penal law, as amended by section 4 of part
I of chapter 57 of the laws of 2015, is amended to read as follows:
S 220.03 Criminal possession of a controlled substance in the seventh
degree.
A person is guilty of criminal possession of a controlled substance in
the seventh degree when he or she knowingly and unlawfully possesses a
controlled substance; provided, however, that it shall not be a
violation of this section when a person possesses a residual amount of a
controlled substance and that residual amount is in or on a hypodermic
syringe or hypodermic needle obtained and possessed pursuant to section
thirty-three hundred eighty-one of the public health law, which includes
the state's syringe exchange and pharmacy and medical provider-based
expanded syringe access programs; nor shall it be a violation of this
section when a person's unlawful possession of a controlled substance is
discovered as a result of seeking immediate health care as defined in
paragraph (b) of subdivision three of section 220.78 of [the penal law]
THIS ARTICLE, for either another person or him or herself because such
person is experiencing a drug or alcohol overdose or other life threat-
ening medical emergency as defined in paragraph (a) of subdivision three
of section 220.78 of [the penal law] THIS ARTICLE; NOR SHALL IT BE A
VIOLATION OF THIS SECTION WHEN A PERSON POSSESSES LESS THAN ONE OUNCE OF
A CONTROLLED SUBSTANCE AND THAT CONTROLLED SUBSTANCE IS A SYNTHETIC
CANNABINOID LISTED IN PARAGRAPH THIRTY-SIX OF SUBDIVISION (D) OF SCHED-
ULE I OF SECTION THIRTY-THREE HUNDRED SIX OF THE PUBLIC HEALTH LAW.
Criminal possession of a controlled substance in the seventh degree is
a class A misdemeanor.

SUBSTANCES ARE OF AN AGGREGATE WEIGHT OF TEN POUNDS OR MORE.
S 10. Subdivisions 3 and 9 of section 220.34 of the penal law, subdi-
vision 3 as amended by chapter 537 of the laws of 1998 and subdivision 9
as added by chapter 264 of the laws of 2003, are amended and a new
subdivision 10 is added to read as follows:
3. concentrated cannabis as defined in [paragraph (a) of] subdivision
four of section thirty-three hundred two of the public health law; or
9. one or more preparations, compounds, mixtures or substances
containing gamma hydroxybutyric acid, as defined in paragraph four of
subdivision (e) of schedule I of section thirty-three hundred six of the
public health law, and said preparations, compounds, mixtures or
substances are of an aggregate weight of twenty-eight grams or more[.];
OR
10. ONE OR MORE PREPARATIONS, COMPOUNDS, MIXTURES OR SUBSTANCES
CONTAINING A SYNTHETIC CANNABINOID LISTED IN PARAGRAPH THIRTY-SIX OF
SUBDIVISION (D) OF SCHEDULE I OF SECTION THIRTY-THREE HUNDRED SIX OF THE
PUBLIC HEALTH LAW AND SAID PREPARATIONS, COMPOUNDS, MIXTURES OR
SUBSTANCES ARE OF AN AGGREGATE WEIGHT OF ONE OUNCE OR MORE.

S 11. Subdivision 9 of section 220.39 of the penal law, as added by
chapter 410 of the laws of 1979, is amended and a new subdivision 10 is
added to read as follows:
9. a narcotic preparation to a person less than twenty-one years
old[.]; OR
10. ONE OR MORE PREPARATIONS, COMPOUNDS, MIXTURES OR SUBSTANCES
CONTAINING A SYNTHETIC CANNABINOID LISTED IN PARAGRAPH THIRTY-SIX OF
SUBDIVISION (D) OF SCHEDULE I OF SECTION THIRTY-THREE HUNDRED SIX OF THE
PUBLIC HEALTH LAW AND SAID PREPARATIONS, COMPOUNDS, MIXTURES OR
SUBSTANCES ARE OF AN AGGREGATE WEIGHT OF SIXTEEN OUNCES OR MORE.
S 12. This act shall take effect immediately.
