S T A T E O F N E W Y O R K ________________________________________________________________________ 9148 I N A S S E M B L Y January 29, 2016 ___________ Introduced by M. of A. RICHARDSON -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to creating mandatory continuing education for teachers relating to mental health issues THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 3001-e to read as follows: S 3001-E. MANDATORY CONTINUING EDUCATION FOR TEACHERS; MENTAL HEALTH ISSUES. 1. THE COMMISSIONER SHALL, IN CONSULTATION WITH THE COMMISSIONER OF HEALTH AND THE COMMISSIONER OF MENTAL HEALTH, CREATE AND ADMINISTER A MANDATORY CONTINUING EDUCATION COURSE FOR TEACHERS RELATING TO MENTAL HEALTH ISSUES. SUCH COMMISSIONERS ARE AUTHORIZED TO MAKE ANY DETERMI- NATIONS NECESSARY FOR THE IMPLEMENTATION OF SUCH EDUCATION COURSE. 2. EVERY TEACHER QUALIFIED TO TEACH PURSUANT TO SECTION THREE THOUSAND ONE OF THIS ARTICLE, SHALL COMPLY WITH THE PROVISIONS OF THE MANDATORY CONTINUING EDUCATION REQUIREMENTS OF THIS SECTION. TEACHERS WHO DO NOT SATISFY THE MANDATORY CONTINUING EDUCATION REQUIREMENTS SHALL NOT TEACH UNTIL THEY HAVE MET SUCH REQUIREMENTS AND HAVE BEEN ISSUED A CERTIFICATE OF COMPLETION. 3. THE CONTINUING EDUCATION PROGRAM SHALL TRAIN TEACHERS TO ACCOMPLISH SAFE DE-ESCALATION OF CRISIS SITUATIONS, RECOGNITION OF THE SIGNS AND SYMPTOMS OF MENTAL ILLNESS, AND TIMELY REFERRAL TO MENTAL HEALTH SERVICES, THE EARLY STAGES OF DEVELOPING MENTAL DISORDERS. THE PROGRAM SHALL ALSO PROVIDE ADDITIONAL RESOURCES NECESSARY FOR TEACHERS TO ASSIST STUDENTS IN CRISIS TO CONNECT WITH APPROPRIATE LOCAL MENTAL HEALTH CARE SERVICES, TRAINING ON MENTAL HEALTH RESOURCES, INCLUDING THE LOCATION OF COMMUNITY MENTAL HEALTH CENTERS IN THE STATE AND LOCAL COMMUNITY, AND TRAINING ON ACTIONS PLANS AND PROTOCOLS FOR REFERRAL TO SUCH RESOURCES. 4. SUCH PROGRAM SHALL BE MADE AVAILABLE TO TEACHERS DURING EVERY PROFESSIONAL DEVELOPMENT PROGRAM, HOWEVER TEACHERS SHALL BE REQUIRED TO ONLY ATTEND ANNUALLY, PROVIDED THAT THEY ARE ISSUED A REGISTRATION CERTIFICATE UPON COMPLETION. TEACHERS SHALL MAINTAIN ADEQUATE DOCUMENTA- TION OF COMPLETION OF CONTINUING EDUCATION PURSUANT TO THIS SECTION AND SHALL PROVIDE SUCH DOCUMENTATION AT THE REQUEST OF THE DEPARTMENT. S 2. This act shall take effect immediately.
