AN ACT to amend the agriculture and markets  law,  in  relation  to  the
  reimbursement of schools for purchasing New York farm products

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 16 of the agriculture and markets law is amended by
adding a new subdivision 5-c to read as follows:
  5-C. THE COMMISSIONER OF EDUCATION SHALL  REIMBURSE  SCHOOL  NUTRITION
PROGRAMS  AT  AN  ADDITIONAL  RATE BASED ON THE PERCENTAGE THAT NEW YORK
FARM PRODUCTS CONSTITUTE OF EACH PROGRAM'S FOOD PURCHASES  IN  A  SCHOOL
YEAR.  SCHOOLS  FOR WHICH NEW YORK FARM PRODUCTS CONSTITUTE AT LEAST TEN
PERCENT OF FOOD PURCHASES WILL BE REIMBURSED AN  ADDITIONAL  FIVE  CENTS
PER  MEAL;  SCHOOLS FOR WHICH NEW YORK FARM PRODUCTS CONSTITUTE AT LEAST
FIFTEEN PERCENT OF FOOD PURCHASES WILL BE REIMBURSED AN  ADDITIONAL  TEN
CENTS  PER  MEAL; SCHOOLS FOR WHICH NEW YORK FARM PRODUCTS CONSTITUTE AT
LEAST TWENTY PERCENT OF FOOD PURCHASES WILL BE REIMBURSED AN  ADDITIONAL
TWENTY-FIVE CENTS PER MEAL.
  THE  COMMISSIONER  SHALL PROVIDE SCHOOLS WITH AN APPROVED VENDOR LIST.
SCHOOLS SHALL VERIFY AND  SUBMIT  THEIR  PERCENTAGE  OF  NEW  YORK  FARM
PURCHASES  TO  THE DEPARTMENT PER THE REIMBURSEMENT SCHEDULE ESTABLISHED
BY THE COMMISSIONER PRIOR TO REIMBURSEMENT.
  S 2. This act shall take effect immediately.
