BILL NUMBER:S1249 TITLE OF BILL: An act to amend the environmental conservation law, in relation to prohibiting the use of unmanned aerial vehicles in the course of hunting PURPOSE OR GENERAL IDEA OF BILL: To prohibit the use of unmanned aerial vehicles for hunting or taking of wildlife. SUMMARY OF SPECIFIC PROVISIONS: The bill defines the term "unmanned aerial vehicle" and prohibits the hunting or taking of wildlife with the aid of an unmanned aerial vehicle. JUSTIFICATION: UAV hunting would allow hunters to use remote-controlled, camera-quipped aircraft to locate wildlife in order to shoot and kill them. Alaska enacted a ban after wildlife officials learned that a moose was killed by a hunter using a UAV. Colorado and Montana have outlawed this practice. In addition, Idaho and Wisconsin have included prohibitions into existing regulations. New Mexico, Vermont and Wyoming have pending rule-making petitions before their wildlife

BOYLE -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting the use of unmanned aerial vehicles in the course of hunt- ing THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 11-0103 of the environmental conservation law is amended by adding a new subdivision 33 to read as follows: 33. "UNMANNED AERIAL VEHICLE" MEANS ANY AIRCRAFT THAT IS OPERATED WITHOUT THE POSSIBILITY OF DIRECT HUMAN INTERVENTION FROM WITHIN OR ON THE AIRCRAFT. S 2. Section 11-0901 of the environmental conservation law is amended by adding a new subdivision 2-a to read as follows: 2-A. NO PERSON SHALL HUNT OR TAKE WILDLIFE WITH THE AID OF AN UNMANNED AERIAL VEHICLE. S 3. This act shall take effect immediately.
