BILL NUMBER:S2148 TITLE OF BILL: An act to amend the education law, in relation to regional tuition rates for special education itinerant services PURPOSE: To allow for regional tuition rates to be provided for special education itinerant services. SUMMARY OF PROVISIONS: Section 1: Amends clause (B) of subparagraph (i) of paragraph a of subdivision 10 of section 4410 of the education law, as amended by section 11 of part A of chapter 56 of the laws of 2014, by establishing regional tuition rates for special education itinerant services beginning in the 2016-2017 school year. Section 2: Sets forth an immediate effective date. JUSTIFICATION: Tuition rates for preschool special education providers that provide special education itinerant services (SEIT) can vary significantly, even programs that are in close proximity to one another. This is primarily because the rates offered to older providers are often lower than rates offered to newer providers. By providing a regional tuition rate it would allow for equity so that SEIT providers can provide the best possible services to preschool age special education students.

FLANAGAN -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to regional tuition rates for special education itinerant services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Clause (B) of subparagraph (i) of paragraph a of subdivi- sion 10 of section 4410 of the education law, as amended by section 11 of part A of chapter 56 of the laws of 2014, is amended to read as follows: (B) (I) Commencing with the two thousand [fifteen] SIXTEEN--two thou- sand [sixteen] SEVENTEEN school year, such special education itinerant services shall be provided by approved programs, and such approved programs shall be reimbursed for such services based on the actual attendance of preschool children receiving such services. (II) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION TO THE CONTRARY, FOR THE TWO THOUSAND SIXTEEN--TWO THOUSAND SEVENTEEN SCHOOL YEAR AND THEREAFTER, THE COMMISSIONER, SUBJECT TO THE APPROVAL OF THE DIRECTOR OF THE BUDGET, SHALL ESTABLISH REGIONAL TUITION RATES FOR SPECIAL EDUCATION ITINERANT SERVICES BASED ON APPROVED ACTUAL COSTS IN ACCORDANCE WITH A METHODOLOGY ESTABLISHED PURSUANT TO SUBDIVISION FOUR OF SECTION FORTY-FOUR HUNDRED FIVE OF THIS ARTICLE.
