BILL NUMBER:S2149 TITLE OF BILL: An act relating to regional tuition rates for special education itinerant services PURPOSE: To create a new base for tuition reimbursement purposes for preschool special education providers. SUMMARY OF PROVISIONS: Section 1: Would require the State Education Department to develop rate setting methodology for classroom based preschool special education providers based on the three most recent years' average, creating a new base for tuition reimbursement. Section 2: Sets forth an immediate effective date. JUSTIFICATION: Unlike other education and human service sectors, the preschool special education system has not benefited from any trend factor or growth factor in reimbursement for approximately 5 years. While actual and reasonable costs associated with the provision of services to school district students by these non-public entities have escalated -- increased fixed costs such as heat and electricity and health care, as well as salaries necessary to recruit and retain qualified teachers and clinical professionals -- rates of reimbursement have not been adjusted. FLANAGAN -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT relating to regional tuition rates for special education itiner- ant services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any inconsistent provision of law, rule or regulation to the contrary, the New York state department of education is hereby directed to develop a rate setting methodology for the calcu- lation of the rates of reimbursement for all classroom based preschool special education programs approved under section 4410 of the education law for the 2015-16 school year where under the actual costs incurred by such program for such classroom operations for the past three years shall be averaged and such average amount shall be the base costs for such program for the 2015-16 school year and shall not be subject to any total cost screen, parameter or other constraint on the full reimburse- ment of actual costs incurred.
