BILL NUMBER:S3435 TITLE OF BILL: An act to amend the general municipal law, in relation to crosswalks near athletic fields and playgrounds PURPOSE OR GENERAL IDEA OF BILL: To require pedestrian crosswalks along athletic fields and playgrounds to permit safe access and passage across abutting streets to pedestrians visiting these facilities. SUMMARY OF SPECIFIC PROVISIONS: Section 1 - provides that this act shall be known as "Erin's Law". Section 2 - amends General Municipal Law by adding a new section 137, which provides (1)that at least one crosswalk will be required across all roads, other than restricted access highways, that abut athletic fields and playgrounds; and,(2) that one or more New York State compliant "pedestrian" or "yield to pedestrian" signs visible to each direction of traffic will be required at each crosswalk. Section 3 - provides that this act shall take effect eighteen months after it shall have become law. JUSTIFICATION: On June 9, 2012, Erin Sulkowski, aged 13, was struck by a car while crossing Maple Road in the Town of Amherst returning home

RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to crosswalks near athletic fields and playgrounds THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as "Erin's law". S 2. The general municipal law is amended by adding a new section 137 to read as follows: S 137. CROSSWALKS NEAR ATHLETIC FIELDS AND PLAYGROUNDS. 1. NOTWITH- STANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, THERE SHALL BE AT LEAST ONE CROSSWALK, AS DEFINED IN SECTION ONE HUNDRED TEN OF THE VEHI- CLE AND TRAFFIC LAW, LOCATED ACROSS EACH ROAD THAT ABUTS AN ATHLETIC FIELD OR PLAYGROUND. 2. THERE SHALL BE LOCATED AT EACH CROSSWALK REQUIRED BY THIS SECTION ONE OR MORE PEDESTRIAN SIGNS (R9-8) OR YIELD TO PEDESTRIAN SIGNS (R1-5A), COMPLIANT WITH THE MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES, VISIBLE TO EACH DIRECTION OF TRAFFIC ALERTING DRIVERS TO YIELD TO PEDES- TRIANS IN THE CROSSWALK. 3. THIS SECTION SHALL NOT APPLY TO RESTRICTED HIGHWAYS. S 3. This act shall take effect eighteen months after it shall have become a law.
