BILL NUMBER:S4691 TITLE OF BILL: An act relating to party boats in Sheepshead Bay PURPOSE: To prevent the docking and anchoring of party boats in Sheepshead Bay, and to prevent party boats from creating noise disturbances SUMMARY OF SPECIFIC PROVISIONS: Section 1 (a) prohibits public noise disturbances in Sheepshead Bay and defines public noise disturbances. (b) prohibits the operation, anchoring, or securing a party boat within Sheepshead Bay. (c) defines party boats as vessels over 14 feet in length operated by an owner or employee and rented for a group recreational event of more than six passengers. (d) exempts fishing boats from provisions of this act. Section 2 provides for an immediate effective date.

SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Cities AN ACT relating to party boats in Sheepshead Bay THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. (a) No person operating a party boat near or around Sheepshead Bay shall knowingly cause, make, allow or permit a public noise disturbance to originate from the vessel, including but not limit- ed to: (1) the frequent, repetitive or continuous sounding of any horn or siren, except as a warning of danger or as specifically permitted or required by law; (2) the creation of frequent, repetitive or continuous sounds in connection with the starting, operation, repair, rebuilding, testing or revving of vessel engines as to unreasonably disturb or interfere with the peace and comfort of others, including owners and possessors of real property; (3) sound from any audio sound system operated at volumes so as to be audible greater than fifty feet from the watercraft itself; or (4) any other sound that unreasonably interferes with the peace and comfort of others. (b) Notwithstanding any provision of law to the contrary, no person shall operate, anchor or secure a party boat within seven hundred fifty feet of the shore of Sheepshead Bay or within one hundred feet of Sheepshead Bay dock. (c) For purposes of this section party boat means a vessel that is fourteen feet in length or longer, measured from end to end over the deck; operated by the owner of the vessel or an employee of the owner; and rented or leased by the owner for a group recreational event consisting of more than six passengers. (d) The provisions of this act shall not apply to fishing boats. S 2. This act shall take effect immediately.
