TITLE OF BILL:

An act to amend the military law, in relation to allowing all veterans
who miss a civil service examination due to active duty military
service the opportunity for a makeup examination

Purpose of the Bill:

This bill amends the Military Law by allowing a make-up examination
for servicemembers who miss a Civil Service examination due to a call
to active duty, including active duty for training.

Summary of Provisions:

Effective immediately, this bill extends the option of a make-up
examination to all servicemembers who miss a New York State Civil
Service exam due to a call to any form of active duty military
service.

Existing Law:

Article 11, Section 243-b of the New York State Military Law allows
servicemembers to take a make-up Civil Service exam if they miss the
scheduled examination due to a call to active duty, except for active

duty for training purposes.

Prior Legislative History:

This is a new bill.

Statement in Support:

Active duty for training is designed "to enhance or refresh existing
skills that support military operations or future mobilizations."
Servicemembers on active duty partaking in such - training to improve
their ability to serve our Nation should not receive a penalty for
missing a Civil Service examination. Instead, they should receive the
same treatment as other servicemembers who are ordered to active duty
and miss a Civil Service exam as a result.  Treating all
servicemembers on active duty equally regarding Civil Service make-up
exams will once again re-affirm New York State's commitment to
welcoming Veterans into State positions.

  committed to the Committee on Veterans, Homeland Security and Military
  Affairs

AN  ACT  to amend the military law, in relation to allowing all veterans
  who miss a civil service  examination  due  to  active  duty  military
  service the opportunity for a makeup examination

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 2 of section 243-b  of  the  military  law,  as
amended  by  chapter  192  of  the  laws  of 2008, is amended to read as
follows:
  2. Notwithstanding any other provision of this chapter  or  any  other
law,  any  member  of the force of the organized militia, as the term is
defined in subdivision nine of section one of this  chapter  or  reserve
armed  forces,  as  that  term  is defined in subdivision twenty-nine of
section two hundred ninety-two of the executive law or any member of the
armed forces of the United States who missed  the  application  deadline
for  a scheduled competitive examination for civil service employment by
the state of New York  or  any  of  its  subdivisions  due  to  military
service,  as  defined in subdivision one of section three hundred one of
this chapter or due to a call to active duty [other than for  training],
pursuant  to  10  USC 101 (d) (1), and is deprived of the opportunity to
compete in such examination due  to  military  service,  as  defined  in
subdivision one of section three hundred one of this chapter or due to a
call  to  active  duty [other than for training], pursuant to 10 USC 101
(d) (1), shall be provided with an opportunity to compete,  under  terms
and  conditions  deemed  appropriate  by  the  state department of civil
service or municipal commission, by way of a  special  military  make-up
examination.

  S 2. Subdivision 3 of section 243-b of the military law, as amended by
chapter 192 of the laws of 2008, is amended to read as follows:
  3.  Notwithstanding  any  other provision of this chapter or any other

  S 3. This act shall take effect immediately.
