BILL NUMBER:S5159 TITLE OF BILL: An act to amend the education law, in relation to the payment of aid to school districts providing an education to Native American pupils PURPOSE: Relates to the payment of state aid to school districts providing an education to Native American pupils SUMMARY OF PROVISIONS: Section 1 amends section 4115 of the education law to require the State to make payment to school districts for the education of Native American students within 180 days of the date that the number of Native American pupils in a school district is determined by the State Education Department. Section 2 provides the effective date. JUSTIFICATION: As of the 2014-2015 School Year, there are approximately 2,500 Native American Students who are being educated in public schools across the State of New York. PANEPINTO -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to the payment of aid to school districts providing an education to Native American pupils THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph b of subdivision 2 of section 4115 of the educa- tion law, as amended by chapter 725 of the laws of 1956, is amended to read as follows: b. [During the first] FOR ANY school year, beginning on or after July first, [nineteen hundred fifty-six] TWO THOUSAND FIFTEEN, in which Indi- an children are educated in the schools of a school district pursuant to the provisions of subdivision two of section forty-one hundred one of this article, there shall be apportioned and paid to each such school district the sum of: (1) Three hundred thirty dollars for each Indian pupil in grades one through six in average daily attendance during the month of October, including kindergarten Indian children who attend for a full day. Where kindergarten Indian children attend but one-half day the district shall be entitled to one hundred sixty-five dollars for each such pupil. (2) Four hundred twelve dollars and fifty cents for each Indian pupil in grades seven to twelve inclusive in average daily attendance during the month of October. SUCH AMOUNT SHALL BE PAID TO THE SCHOOL DISTRICT WITHIN ONE HUNDRED EIGHTY DAYS OF THE DATE THAT THE NUMBER OF INDIAN PUPILS EDUCATED BY THE DISTRICT IS DETERMINED BY THE DEPARTMENT. S 2.
