BILL NUMBER:S5357 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to authorizing "right on red" in Richmond county PURPOSE: Authorizes traffic in the county of Richmond to make a right turn at a red traffic light after stopping as required. SUMMARY OF SPECIFIC PROVISIONS: Traffic facing a steady circular red signal may cautiously enter the intersection to make a right turn after stopping as required by vehicle and traffic law. JUSTIFICATION: To help move traffic in Staten Island in a more efficient and reasonable manner. Richmond County is a borough with a population of less than 500,000. That is roughly 1/3 the population of the 4th most populated borough, The Bronx. A law allowing the cautious execution of right-on-red turns would serve to better align the vehicle traffic law with the more suburban traffic patterns on Staten Island, as opposed to the urban traffic patterns of the other boroughs. SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to authorizing "right on red" in Richmond county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 2 of subdivision (d) of section 1111 of the vehi- cle and traffic law, as separately amended by chapters 230 and 420 of the laws of 1980 and subparagraph c as added by chapter 317 of the laws of 1997, is amended to read as follows: 2. Except in [a city having a population of one million or more] THE COUNTIES OF NEW YORK, KINGS, QUEENS AND BRONX, unless a sign is in place prohibiting such turn: a. Traffic facing a steady circular red signal may cautiously enter the intersection to make a right turn after stopping as required by paragraph one of this subdivision, except that right turning traffic is not required to stop when a steady right green arrow signal is shown at the same time. Such traffic shall yield the right-of-way to pedestrians within a marked or unmarked crosswalk at the intersection and to other traffic lawfully using the intersection; b. Traffic, while on a one-way roadway, facing a steady red signal may cautiously enter the intersection to make a left turn onto a one-way roadway after stopping as required by paragraph one of this subdivision. Such traffic shall yield the right-of-way to pedestrians within a marked or unmarked crosswalk at the intersection and to other traffic lawfully using the intersection. c. On or after the effective date of this subparagraph, the sign which prohibits such turn shall be prominently displayed from all newly installed traffic signals where possible.
