                                BILL NUMBER:S5364

TITLE OF BILL:  An act to amend the vehicle and traffic law, in
relation to establishing a distinctive "Jamaican bobsled team" number
plate

PURPOSE:  The purpose of this legislation is to allow for the issuance
of a distinctive Jamaican Bobsled team number plate of a design
developed and approved by the commissioner, in cooperation with the
Jamaica Bobsled Foundation.

SUMMARY OF PROVISIONS:  The vehicle and traffic law is amended by
adding a new section 404-x.

1. Any resident of New York State may upon request, be issued a
distinctive "Jamaican Bobsled team" number plate of a design developed
and approved by the commissioner in cooperation with the Jamaican
Bobsled Foundation. An application for such a number plate shall be
filed with the commissioner.

2. The distribution of a "Jamaican Bobsled team" number plate shall be
issued in the same manner as other number plates upon the payment of
regular registration fees. An annual service charge of twenty five
dollars will be charged for such a plate. Such charge will be
deposited pursuant to the provisions of section four hundred four-oo
to the plate development fund of the department of motor vehicles.

This fund shall be used for the production, design, advertising, and
marketing of distinctive license plates. Annual service charges
collected in excess of six thousand dollars shall be paid by the State
comptroller to the Jamaica Bobsled Foundation.

JUSTIFICATION:  The Jamaican Bobsled team was first formed in in
preparation for the 1988 Winter Olympics in Calgary, Alberta. They
were immediately seen as popular underdogs being from a tropical
island and competing in a notorious winter sporting event. The
Jamaican Bobsled legacy continued after several more appearances in
subsequent Winter Olympics, and stunned many of their critics by
finishing in 14th place in the 1994 Olympic Games, finishing ahead of
Russia, the United States, Australia and France.

The creation and sale of a "Jamaica Bobsled team" designed license
plate would benefit the team as it aims to generate support and
popularity through the promotion with proceeds going towards the
Jamaican Bobsled Foundation spearheaded by Executive Director Noel
Spencer and one of the inaugural Olympic team members, Devon Harris.
With many Jamaican immigrants residing in the State, the establishment
of this plate would provide residents an opportunity to support and
fund the country's team in its training and journey back to the
Olympics.

AN ACT to amend the vehicle and traffic law, in relation to establishing
  a distinctive "Jamaican bobsled team" number plate

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  vehicle  and  traffic law is amended by adding a new
section 404-x to read as follows:
  S 404-X. DISTINCTIVE "JAMAICAN BOBSLED TEAM"  NUMBER  PLATES.  1.  ANY
PERSON  RESIDING IN THIS STATE SHALL, UPON REQUEST, BE ISSUED A DISTINC-
TIVE "JAMAICAN BOBSLED TEAM" NUMBER PLATE  OF  A  DESIGN  DEVELOPED  AND
APPROVED  BY  THE  COMMISSIONER, IN COOPERATION WITH THE JAMAICA BOBSLED
FOUNDATION.  APPLICATION FOR SUCH NUMBER SHALL BE FILED WITH THE COMMIS-
SIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE.
  2. A DISTINCTIVE "JAMAICAN BOBSLED TEAM" NUMBER PLATE ISSUED  PURSUANT
TO  THIS  SECTION  SHALL  BE  ISSUED  IN THE SAME MANNER AS OTHER NUMBER
PLATES UPON THE PAYMENT OF THE REGULAR REGISTRATION  FEE  PRESCRIBED  BY
SECTION  FOUR  HUNDRED  ONE  OF THIS ARTICLE, PROVIDED, HOWEVER, THAT AN
ADDITIONAL ANNUAL SERVICE CHARGE OF TWENTY-FIVE DOLLARS SHALL BE CHARGED
FOR SUCH PLATE.  SUCH ANNUAL SERVICE CHARGE SHALL BE DEPOSITED  PURSUANT
TO THE PROVISIONS OF SECTION FOUR HUNDRED FOUR-OO OF THIS ARTICLE TO THE
CREDIT OF THE DEPARTMENT OF MOTOR VEHICLES DISTINCTIVE PLATE DEVELOPMENT
FUND  ESTABLISHED BY SECTION NINETY-FIVE-G OF THE STATE FINANCE LAW, AND
SHALL BE USED FOR THE PRODUCTION, DESIGN, ADVERTISING AND  MARKETING  OF
DISTINCTIVE  LICENSE  PLATES  PURSUANT  TO  SUCH  SECTION NINETY-FIVE-G;
PROVIDED, HOWEVER, THAT ANNUAL SERVICE CHARGES COLLECTED  IN  EXCESS  OF
SIX  THOUSAND  DOLLARS  SHALL  BE  PAID  BY THE STATE COMPTROLLER TO THE
JAMAICA BOBSLED FOUNDATION.
  S 2. This act shall take effect immediately.
