BILL NUMBER:S5471 TITLE OF BILL: An act to amend the environmental conservation law, in relation to prohibiting the sale and distribution of glyphosate and products containing glyphosate PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to prohibit the sale and distribution of glyphosate and products containing glyphosate in the state of New York. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill adds a new section 37-0115 to the environmental conservation law to prohibit the sale, distribution, or use of glyphosate or any products containing glyphosate by any person, firm, partnership, association, LLC, or corporation within New York state, and authorizes the department of environmental conservation to promulgate rules and regulations necessary to carry implement the provisions of the act. Section 2 of the bill provides the effective date.

HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting the sale and distribution of glyphosate and products containing glyphosate THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 37-0115 to read as follows: S 37-0115. PROHIBITION OF GLYPHOSATE AND PRODUCTS CONTAINING GLYPHOSATE. 1. NO PERSON, FIRM, PARTNERSHIP, ASSOCIATION, LIMITED LIABILITY COMPA- NY OR CORPORATION SHALL DISTRIBUTE, SELL, OFFER FOR SALE OR USE GLYPHO- SATE OR ANY PRODUCTS CONTAINING GLYPHOSATE WITHIN NEW YORK STATE. 2. FOR THE PURPOSES OF THIS SECTION, GLYPHOSATE SHALL MEAN A SYNTHETIC COMPOUND THAT IS A NON-SELECTIVE SYSTEMIC HERBICIDE, ALSO KNOWN AS N-(PHOSPHONOMETHYL) GLYCERINE WITH A CHEMICAL FORMULA OF C3H8NO5P. 3. THE DEPARTMENT IS AUTHORIZED TO PROMULGATE SUCH RULES AND REGU- LATIONS AS IT SHALL DEEM NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION. S 2. This act shall take effect one year after it shall have become a law; provided, however, that effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date is authorized and directed to be made and completed on or before such effective date.
